Some may have seen this on TDS but I am just trying to clear up some misconceptions about testing since I am the only person I know who has been tested. Well Monday 9/25 I got checked for off road diesel on a random test on private property. I was OK but some others who were there got caught running off road diesel. I was told by the IL Dept of Revenue officers that the fines are a flat rate for the state of IL but Federal fines differ. The first offence is $2500, second offence is $5000, and anything more than that is fines and jail time. I asked about them not being allowed to random test on private property and they chuckled and said "that is a very common misconception. They can go anywhere within the IL borders even on private property and inside buildings." I informed them I was running B20 and they said "we don't care about that."
in IL they can test you where they want. auctionsand construction sites bing #1. also weigh station DOT inspections.....
I had a boss who got caught running it in his one tons and dump trucks and and tractor the fees he was fined but he greased the palms of justice got off nice
From what I have read they (Feds) can go anywhere in any state to check for non-taxed fuel. http://www.irs.gov/pub/irs-pdf/n916.pdf#search="Dyed%20Diesel%20Inspection%20Notice"
